Training Terms & Conditions

The Training Services Terms and Conditions apply between you, the Client and AIXR, a company incorporated in England and Wales with registered number 10116144 whose registered office is at 65b North Hill, Essex, CO1 1PX; the owner and provider of this Website and Training Services.

Live Courses

  1. Definition
    1. Live Courses are defined as educational or professional courses, where the content is delivered by a trainer over the internet or an electronic network (in other words, using a remote link)
    2. An AIXR Live Course is deemed started as soon as any course materials are accessed online.
  1. Payment
    1. Live Course fees must be paid in full, prior to the course start state via the secure card payment gateway at time of booking.
    2. Fees quoted are correct at time of publication, however AIXR reserves the right to alter Fees at any time.
    3. Prices quoted are exclusive of UK VAT, organizations & individuals based within the UK will be subject to VAT applied to live course fees.
    4. AIXR reserves the right to exclude a delegate from a course if payment is not received on time.
  1. Substitutes
    1. Clients may substitute the original delegate with another Student at no extra charge for 1 day and multi-day Live Courses.
      1. Written confirmation is required a minimum of 3 days in advance to the Live Course date
      2. The Client acknowledges a substituted Student may not receive automated pre-course information
  1. Transfers
    1. Written notice is required to transfer a booking to another Live Course. Course bookings can be transferred without charge when notice is received 31 or more days prior to the start date of the originally booked course.
    2. Where notice to transfer from the originally booked Live Course is given:
      1. within 15–30 days (inclusive) a 25% charge applied based on the original fee.
      2. within 1–14 days (inclusive) a 50% charge applied based on the original fee
    1. If a Live Course transfer is canceled or changed at any time, the full course fee remains payable.
  1.  Cancellation by the Client
    1. Client must give written notice to the AIXR if they wish to cancel or defer a booked Course.
    2. If a Course booking is canceled or deferred by the Client, AIXR reserves the right to apply the following cancellation charges based on the total Fee:
      1. More than 31 days – 100% Refund or Credit
      2. 15 – 28 days – 75% – Credit Only
      3. 1 – 14 days – 50% Credit Only
      4. 0 days (day of course) – 10% Credit Only
      5. Non-attendance without notice – 25% Administration Fee
  1. Cancellation by AIXR
    1. AIXR reserves the right to cancel or alter the dates or provision of Live Courses, the Platform and the individual or organization providing the Course.
    2. In the event of a Live Course cancellation, at the discretion of AIXR, bookings may either be deferred to the next available Course or transfer to an similar Live Course at no additional fee to the Client
  1. Certificates
    1. Live Course certificates are:
      1. normally issued within 4 weeks following the completion of a Live Course, but may take longer. Certificates issued by another organization remain outside of AIXR’s control and will be issued on receipt by us. No certificates will be issued until full payment has been received by AIXR.
      2. only issued to the Student in attendance to the Live Course, which may differ from the Client’s name. Certificates are only issued to individuals, not organizations.
      3. inclusive of the Live Course total cost and is not subject to any additional fees
      4. not subject to testing or examination as they are issued directly by a certified AIXR trainer

On Demand Courses

  1. Definition
    1. On Demand courses are defined as an online course consisting of pre-recorded videos and downloadable PDFs
  1. Payment
    1. First Party AIXR delivered On Demand Courses are provided free of charge. Third-party on demand courses may be subject to fees outside of AIXR’s control and will be listed as such. User’s may have the opportunity to complete a short test to receive a certification from AIXR for an additional fee. On-Demand Certifications are classified as an electronically supplied service and therefore the associated fees are subject to UK VAT, regardless of a User’s local taxation laws. Prices quoted are exclusive of UK VAT.
  1. Certificates
    1. On-Demand Course certificates are:
      1. issued upon successful completion of an On-Demand Certificate Test, but in some cases may be held for review . Certificates issued by another organization remain outside of AIXR’s control and will be issued on receipt by us.
      2. only issued to the name associated with the registered account the Client used to take the test. Certificates are only issued to individuals, not organizations and names can not be substituted or changed without a retest.
      3. subject to the certification fee as outlined in 2.2.1
      4. applicable for unlimited free test resits

Corporate Training

  1. Definition
    1. Corporate training is defined as bespoke or bulk purchased, education, training, or a similar service delivered by a person over the internet or an electronic network or in person.
  1. Exclusion
    1. Corporate training is not subject to the terms and conditions listed on this page, and instead will refer to AIXR’s training booking form and terms and conditions (available on request).

In General

  1. Intellectual property
    1. AIXR and its licensors shall retain full ownership of all materials provided prior, during and after training, and assert their right to worldwide copyright unless specifically agreed otherwise in writing.
    2. Recording or screen capture of any training services is strictly prohibited and violates the copyright and intellectual property of AIXR.
  1. Data Protection & GDPR
    1. These terms and conditions adhere to AIXR’s privacy policy which can be found at https://aixr.org/privacy-policy/
  1. No-Solicitation
    1. Except in respect of any transfer of employees of AIXR to the Client pursuant to the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246), the Client shall not, without the prior written consent AIXR, at any time from the Booking Date to the expiry of 8 months after the completion of training services, solicit or entice away from AIXR or employ or attempt to employ any person who is, or has been, engaged as; a trainers/tutors, an employee, consultant or subcontractor of AIXR.
  1. Liability
    1. AIXR shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct or indirect or consequential) which may be suffered or incurred by the Client as a result of the services provided.
    2. The Client shall be liable for the acts and omissions of its representatives and shall ensure that they comply in full with the obligations set out in this Agreement.
    3. AIXR reserves the right to change the Training Services Terms and Conditions at any time.
  1. Severability
    1. In the event that any of the provisions of these terms and conditions are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.
  1. Governing Law
    1. These terms and conditions shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the terms and conditions (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
